This licence applies to the original source code, design, text, images, and other material in the VanillaSquared Website repository at https://github.com/VanillaSquared/Website that is owned by the Licensor (collectively, the “Website Material”).
1. Definitions
“Licensor” means Adrian Orlik, operating under the project name VanillaSquared.
“Private Use” means use only by you, in an environment under your control, that does not make the Website Material or a running copy of the website available to any other person. An access-controlled build or continuous integration service may be used solely to compile or test the Website Material, provided that it does not serve the website to any person.
“Contribution” means code, content, documentation, or another change that you intentionally submit to the Licensor for possible inclusion in the official VanillaSquared Website repository.
“Third-Party Material” means material identified as belonging to another person or project, including dependencies, libraries, fonts, trademarks, and material carrying a separate licence or notice.
2. Permission
Subject to this licence, the Licensor grants you a limited, worldwide, royalty-free, non-exclusive, non-transferable, and revocable licence to:
a. access and use the official website in the ordinary manner intended for its visitors;
b. clone or download the Website Material;
c. reproduce, modify, compile, and test the Website Material for Private Use; and
d. use GitHub’s normal repository and forking features solely as reasonably necessary to prepare and submit Contributions to the official repository.
3. Contributions
You may publish a proposed change only by submitting it as a Contribution to the Licensor through the official repository or another contribution channel approved by the Licensor. This narrow permission does not permit independent publication or distribution of the Website Material.
By intentionally submitting a Contribution, you represent that you have the right to submit it and grant the Licensor a perpetual, worldwide, non-exclusive, irrevocable, royalty-free licence to use, reproduce, modify, adapt, publish, distribute, sublicense, host, and commercially exploit the Contribution as part of or in connection with VanillaSquared projects. You retain copyright in any original material you contribute.
4. Restrictions
Except with the Licensor’s prior written permission, you must not:
a. publish, republish, share, distribute, sell, sublicense, or otherwise make available any copy of the Website Material, a modified version, or a compiled build, except for a Contribution permitted by section 3;
b. deploy, host, mirror, or serve the Website Material, a modified version, or a compiled build on the Internet or any other network, whether access is public or restricted;
c. use the Website Material, a modified version, or a compiled build for commercial purposes, advertising, sponsorship, paid services, fundraising, revenue generation, or any other direct or indirect financial benefit;
d. claim or imply that you created the Website Material or the VanillaSquared website, or misrepresent your relationship with or endorsement by the Licensor. You may accurately identify your own Contribution; or
e. remove, conceal, or alter copyright, authorship, trademark, or licence notices.
5. Ownership and reserved rights
The Website Material is licensed, not sold. The Licensor retains all rights, title, and interest in the Website Material. No trademark rights or rights in the VanillaSquared name, logos, branding, domain names, or trade dress are granted. All rights not expressly granted by this licence are reserved.
6. Separate and earlier licences
Third-Party Material is governed by its own terms and is not relicensed under this licence. Material that the Licensor previously released under CC0 or another licence remains available under that earlier licence; this licence does not withdraw or restrict permissions already granted for those releases. Where a file contains a separate licence or notice, that separate licence or notice controls for that file.
7. Termination
This licence terminates automatically if you breach it. Upon termination, you must stop using the Website Material and delete all copies in your possession or control, except to the extent retention is required by law. Sections 3, 5, 6, 8, and 9 survive termination.
8. Disclaimer of warranty
TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE WEBSITE MATERIAL IS PROVIDED “AS IS” AND “AS AVAILABLE”, WITHOUT WARRANTIES OR CONDITIONS OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING WARRANTIES OF TITLE, NON-INFRINGEMENT, MERCHANTABILITY, OR FITNESS FOR A PARTICULAR PURPOSE.
9. Limitation of liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE LICENSOR WILL NOT BE LIABLE FOR ANY DIRECT, INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF DATA, PROFITS, REVENUE, OR BUSINESS, ARISING FROM THE WEBSITE MATERIAL OR THIS LICENCE, UNDER ANY THEORY OF LIABILITY.
10. Entire licence and severability
This document states the entire licence granted for the Website Material. Any additional permission or exception must be in writing from the Licensor. If a provision is held unenforceable, it will be limited or removed only to the minimum extent necessary, and the remaining provisions will continue in effect.
11. Acceptance
By exercising any permission granted in section 2, you accept and agree to this licence. If you do not agree, do not copy, modify, compile, or otherwise use the Website Material beyond rights that applicable law gives you without permission.
